Georgia woman faces DUI charges

A Hampton woman is facing a variety of charges following an accident that claimed the life of a 26-year-old man. Georgia State Patrol reports that the woman was arrested following the crash and now faces DUI charges as well as several related charges in the tragic death. No court date has been announced for her at this time. 

According to the accident report, the 42-year-old woman stopped in the middle lane of Interstate 75 North with no lights on around 5:20 a.m. on the morning of Sept. 17. Another vehicle, driven by a 26-year-old man, was unable to stop in time before hitting the stopped vehicle from behind. The force of the impact forced both vehicles off the right shoulder and into the guard rail. 

The man was declared dead at the scene by arriving medical personnel. The accident caused injury to the woman as well, though the extent of her injuries was not reported. She was taken to a local hospital for treatment, and a warrant was issued for her arrest following her release from the hospital. She faces charges including DUI and involuntary manslaughter. 

Georgia prosecutors will have to prove the woman was under the influence of drugs or alcohol at the time of the crash if they hope to convict her on the DUI charges she faces. However, her defense team will want to review the arrest record to assess whether police followed due process in determining her status at the time of the crash. If the proper tests were not administered, or if they were administered too late for the results to be admissible in court, the charges could be reduced or even dropped.
