Georgia man faces DUI charges

A 23-year-old man is in police custody following an altercation with officers who say he was driving drunk. The man was arrested the night of Dec. 26 after a serious two-vehicle crash on U.S. 27 in Georgia. The man has since been released on bail, but his court appearance to face his DUI charges should be upcoming. 

According to the accident report, the man was traveling at a high rate of speed southbound on U.S. 27 when the accident occurred, which was around 6:00 p.m. The man lost control of his vehicle, which entered the left shoulder before he overcorrected into the slow lane. His vehicle struck a pickup truck, which then overturned. The man's vehicle spun around and smashed into a guard rail, causing emergency response teams to have to saw the driver's side door off to extricate the man. 

Fire fighters on the scene reported the man smelled of alcohol, and he allegedly solicited at least one fire fighter with lewd requests while being rescued. The man was subsequently arrested, though the report does not list any sobriety tests that may have been administered at the scene. He now faces charges including DUI, reckless driving, solicitation and failure to maintain a lane. 

If the man is found guilty of these charges, particularly the DUI charges, he could face jail time and will almost certainly have his license suspended or revoked altogether. Thankfully, the man is protected by the presumption of innocence, while the burden of proof lies with Georgia prosecutors to prove the man was drunk behind the wheel. His defense team will review any evidence the prosecution plans to bring to court to ensure the man's rights are observed throughout the proceedings.
